Terms and conditions

1. Seller and scope

The seller is the Dutch entity identified under “Contact & provider details”. InCarUpgrades is an independent provider and is not an authorised BMW, MINI or Apple partner. Trademarks are used only to describe compatibility. The current shop is for consumers only.

2. Order and contract

The product description, compatibility notes and total price are displayed before an order with an obligation to pay is placed. Clicking the payment button submits a binding offer. The contract is formed when Mollie confirms payment and the order confirmation is sent on a durable medium. A browser return alone never confirms payment.

3. Compatibility and customer data

The shop selector is a recommendation, not a final compatibility promise. After confirmed payment, required vehicle and system data is collected securely for manual review. You must provide complete and accurate information. Delivery begins only after compatibility is confirmed. If the ordered product is incompatible, we offer a suitable alternative only with your agreement; otherwise we refund the amount paid.

Where a vehicle-bound digital supply is provided in accordance with the data you submitted, unusability caused solely by incorrect or incomplete data that could not reasonably be identified during the agreed review is not a lack of conformity caused by us. Mandatory consumer rights remain unaffected.

4. Prices, VAT and payment

Consumer prices are shown before payment as the total price including VAT applied for the delivery country. Mollie processes the payment. The product, tax and total amounts confirmed at checkout and on the resulting invoice are controlling.

5. Digital delivery

Delivery is made digitally through the order page and/or stated email address after payment, required vehicle details and compatibility have been confirmed. Any delivery window shown on the product page starts only when all required information is complete. Manual review, missing data or a necessary follow-up may delay delivery; the protected order view shows the current status.

6. Licence

Unless stated otherwise, you receive a personal, non-transferable right to use the delivered file, guide or activation for the confirmed vehicle and system. Copying, resale, publication or supply to third parties is prohibited. A lifetime FSC code is tied to the confirmed VIN, head unit, map family and region; future map material is not automatically included.

7. Statutory remedies

Your statutory consumer rights for digital content and services remain unaffected. If the supply is not in conformity, first allow us to bring it into conformity within a reasonable time and without significant inconvenience. Where the law permits, you may then seek a proportionate price reduction or terminate the contract and obtain a refund.

8. Withdrawal

Your withdrawal rights and the conditions for starting digital supply early are set out in the separate withdrawal information. Payment or VIN-binding alone does not remove the right of withdrawal. If you expressly consented to an early start at checkout, acknowledged the loss of the right and received the contract confirmation, digital content cannot be withdrawn merely because you changed your mind after supply begins. Rights concerning defective or non-conforming performance remain unaffected.

9. Liability

Nothing limits liability for intent, gross negligence, death or personal injury, or mandatory product-liability and consumer rights. For other slightly negligent breaches, liability applies only to essential contractual duties and is limited to damage typically foreseeable.

10. Complaints, dispute resolution, law and courts

Complaints may be submitted using the provider contact details. Dutch law applies without depriving you of mandatory consumer protections in your country of habitual residence. Claims may be brought before any court competent under mandatory consumer law.

We do not employ more than ten people and are not required to provide a general participation statement for consumer arbitration. After a dispute arises, we will provide the legally required information.

The consumer mediator required for French consumers is not finally configured yet. France must not go live until these details are confirmed.
